1.- Purpose and Overview

The General Conditions of Contract (hereinafter the “General Conditions”), together with any particular conditions that could apply, regulate the conditions of purchase of products through the website www.sense4care.com (hereinafter the “Web Site”or the”Portal”), owned by Sense4Care S.L. (hereinafter Sense4Care), with CIF B-65870800, whose registered office is located at Carrer Tirso de Molina 36, 08940 Cornella de Llobregat.

The use of the services of the Web site, and the acquisition of any of the products offered, constitutes acceptance by the User, without reservations of any kind, of each and every one of these General Conditions. Registration on the site and use of its services means that User’s data will be part of Sense4Care files, and their treatment will be as provided in the Privacy Policy, that User expressly acknowledges and accepts.

Sense4Care provides information about products, and offers the possibility of purchasing them through the Web Site. A User intending to purchase products must have the status of “Registered User”, which is acquired by completing the relevant registration form prior to the purchase process and following the steps Sense4Care communicates via the Web Site.

These Terms, together with the Legal Notice and Privacy Policy of the Web Site are the only conditions applicable to the use of the Portal and the purchase of products through it and replace any other terms, except by prior written agreement between Sense4Care and User. Consequently, the User who accesses the Web Site, signs up and purchases products through the Web Site consents and is bound by the General Conditions, the Legal Notice and Privacy Policy as are found written in the time when you access the web Site.

2.- Product information

Pictures, graphic or iconographic materials and videos relating to the products sold by Sense4Care as well as trade names, trademarks or logos of any kind contained on the website, are intended to provide as much information as possible. However, the user must consider that they have an indicative purpose and therefore lack exhaustive character.

Sense4Care reserves the right to decide, at all times, the products offered to Users through the Portal. Thus, Sense4Care may at any time add new products to those included in the Portal, understood that, unless stated differently, such new products shall be governed by the provisions of the General Terms that are in effect at that time.

Also Sense4Care reserves the right to cease providing access, at any time and without prior notice, to any of the products offered on the Portal.

In the case where, for reasons of force majeure, a product is unavailable after the purchase has been made, Sense4Care will inform the User by email of the total or, where applicable, partial cancellation of the order. The partial cancellation of the order does not entitle the cancellation of the entire order, without prejudice to the right of withdrawal, which corresponds to the User as provided in these Terms and Conditions.

3.- Modifications of Terms and Conditions

Sense4Care reserves the right to modify, at any time and without prior notice, the presentation and configuration of the Web Site, as well as the Terms and Conditions. Users will always have these Terms and Conditions in a visible location, freely accessible to all queries they want to perform. Users agree to read these Terms and Conditions each time they access the Web Site store. In any case, acceptance of the Terms and Conditions will be an essential prerequisite to purchasing any product available through the Web Site.

4.- Communications between Sense4Care and the User

All communications between Sense4Care and User relating to these Terms and Conditions or the purchase of products through the Web Site, shall be in written form and in accordance with the procedures of communication laid down in these Terms and Conditions for each particular case.

For other assumptions that are not specifically covered by these Terms and Conditions, communications that the user wishes to send to Sense4Care shall be sent to the address of Sense4Care indicated in the first condition and shall be in written form and through a system that can demonstrate the content and reception by Sense4Care of the corresponding communication.

6.- Partial nullity

If any clause of these Terms and Conditions is declared invalid, it will be removed or replaced. In any case, such invalidity shall not affect the validity of the remaining clauses in these Terms and Conditions.

7.- Applicable Law and Jurisdiction

These Terms and Conditions are governed and interpreted according to Spanish law.

In the event that any discrepancy or claim between the parties regarding the implementation or content of these General Conditions occurs, the parties agree to submit the decision of the case brought to the Courts and Tribunals in accordance with the applicable law.
